prove unfit father in custody hearing?
my ex is taking me to court next week and i have to prove him unfit to keep my 16month old from overnight visits.the only thing i have agreed to is day visits only. i have taken some pics last week of his marijuana and his vaporizer and bowl he smokes out of, plus i have ordered a drug test(even though he says he’s taking this stuff to get the weed out of his system) and i have a medical doctor’s records of him cursing everyone out in the dr office and friends and family that is testifying his temer and anger issues. do u think that’s enough to prove him unfit? he is very abusive mentally, verbally,physically to me. i have to protect my son- i have tried to work things out so we could be a family b/c my ex said that he has changed, but when it comes down to it he hasnt. please help me any info will be great.
If you have an unbiased report of his temper (the dr) that is going to carry a lot more weight then potentially biased reports (your friends and family).
But really if you have enough proof of his temper and anger issues, and then top it off with drug issues, that would make it unlikely that you would be able to get such a young child overnight. Temper issues and not knowing how to handle a child are what have led to so many babys ending up killed at the hands of fathers/mothers bfs left alone with baby. Make sure you are making it clear that your not wanting him to have the baby is your consern for the baby, and what could happen if the baby would spark his temper, not spite issues, which many moms do. Your son is at an age that he can not speak for himself, can not tell you if anything bad happens, and can not protect himself
